The Ordinance stipulates that "designated professionals" who work in specific professions in Hong Kong and have frequent contact with children must report to the competent authority "as soon as possible" when they have "reasonable suspicion" that a child under the age of 18 is "suffering serious harm" or "at risk of substantially suffering serious harm" in the course of their work.

I. Key Points of the Regulations

  • The ordinance will come into effect 18 months after its publication in the Gazette, i.e., on January 20, 2026.

  • "Children" refers to persons under the age of 18.

  • The regulations list 25 categories of "designated professionals," covering fields such as education, healthcare, social welfare, and psychology.

  • "Serious injury" includes, but is not limited to: loss or damage to limb function, damage to internal organs, loss of consciousness, significant threat to mental health or development, or endangerment of a child's life or health due to the negligence of a guardian.

  • Professionals who fail to report under reasonable suspicion may face penalties: a maximum fine of HK$50,000 and imprisonment for up to 3 months.

  • After a report is filed, the regulations provide legal protection for the whistleblower: for example, their identity must not be disclosed, and they will not bear civil or criminal liability.

II. Why introduce the regulations?

In recent years, cases of child abuse have been frequent in Hong Kong, drawing widespread public attention. The government has stated that it needs to "establish a broader and more effective protection network," and therefore promoted a mandatory reporting system. The introduction of the ordinance will help to "identify and intervene early" in suspected child abuse cases, reducing the continuation of harm.

III. Who is affected/How should we prepare?

  • The public can participate in advocacy and learn to recognize early signs of child abuse through educational institutions and community centers, thus promoting a safe home/school culture.

  • Some argue that a mandatory reporting system may lead to the risk of false reports or affect children's autonomy.

  • Balancing the protection of children with the judgment of professionals is an important practical issue.

  • Whether an organization has sufficient resources to handle whistleblower cases is also crucial.
